1. Introduction and Acceptance

This website (the "Site") is operated by BizRevive ABN 91 211 975 084 ("we", "us", "our", or "BizRevive"). These Terms and Conditions ("Terms") govern your access to and use of the Site, and the purchase of any products or services ("Products" or "Services") from us.

By accessing or using the Site, placing an order, or otherwise engaging with our Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase from us.

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

2. Our Products and Services

We specialise in custom-programmed NFC (Near Field Communication) products, such as tags, cards, or similar hardware that link to digital content (e.g. business profiles, reviews and social media). Products are custom-encoded based on the information and links you provide during the order process.

3. Orders and Accuracy of Information

You must provide current, complete, and accurate billing, shipping, and account information for all purchases. We reserve the right to refuse or cancel any order, limit quantities, or limit sales to any person, geographic region, or jurisdiction at our sole discretion.

4. Pricing and Modifications

Prices are in Australian Dollars (AUD) and are subject to change without notice. We reserve the right to modify or discontinue any Product, Service, or the Site (in whole or part) at any time without notice or liability.

5. Payment

Payments are processed securely via Shopify. You authorise us to charge the selected payment method for the total amount, including any applicable taxes and shipping fees.

6. Shipping, Delivery, and Risk

• We offer free standard shipping within Australia.
• Orders involve custom programming and are typically dispatched within 1–2 business days.
• Risk of loss or damage passes to you upon delivery (confirmed by the carrier's tracking).
• If an item is lost or damaged in transit (as confirmed by carrier investigation), we will replace it at no extra cost.
• We are not responsible for delays caused by carriers, customs (for international orders), or events beyond our reasonable control.

7. Custom Programming and Specific Disclaimers

• 7.1 Data Accuracy — We program NFC chips exactly as per the digital links and business information (e.g. name and address) you provide. You are solely responsible for the accuracy and legality of all provided content.
• 7.2 No Reprogramming — Once programmed and delivered, Products cannot be reprogrammed by us.
• 7.3 Device Compatibility — NFC performance varies by device, operating system, and settings. It is your responsibility to verify compatibility before purchase.
• 7.4 Third-Party Platform Changes — We are not liable for changes, restrictions or removals by third-party platforms (e.g. Google, Instagram, Facebook and review sites) which affect link functionality after delivery.
• 7.5 No Outcome Guarantees — We do not guarantee any specific results, such as number of reviews, ratings, traffic or business outcomes from using our Products.

8. Intellectual Property and No Affiliation

All content on the Site and our Products (excluding your supplied data) is owned by us or our licensors. BizRevive is not affiliated with, endorsed by, or connected to Google, Instagram, Facebook or any other third-party platform referenced in our Products.

9. Prohibited Uses

You must not use the Site or Products for any unlawful purpose, to infringe intellectual property rights, or in violation of any third-party platform's policies (including deceptive practices).

10. User Feedback and Submissions

Any comments, feedback, suggestions, or materials you submit may be used, edited, copied, published, or distributed by us without compensation or obligation.

11. 30-Day Change of Mind Guarantee

We offer a 30-day change of mind guarantee. If you're not completely satisfied, you can return your NFC product within 30 days, as long as it is unused and in its original condition. Once we receive your return, we'll inspect it to ensure it meets our return conditions. If approved, we will process your refund promptly. Please note, return shipping costs are the customer's responsibility.

This is a voluntary policy and does not affect your statutory rights.

12. Lifetime Chip Warranty (Voluntary Manufacturer's Warranty)

We provide a lifetime warranty against manufacturing defects in the NFC chip's functionality (for the reasonable lifetime of the chip).

• To claim, provide video evidence showing: (a) the Product's physical condition, and (b) the failure to scan/read on an NFC-compatible device.
• This warranty excludes physical damage (e.g. breakage, cracks or snaps), misuse, normal wear and tear or issues caused by device incompatibility or third-party changes.
• This is in addition to and does not limit your rights under the Australian Consumer Law.

13. Third-Party Tools, Links, and Optional Features

The Site may contain links to or integrate third-party tools/platforms. We provide these "as is" and are not responsible for any harm, damages, or issues arising from their use.

14. Australian Consumer Law Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For services: If there is a major failure, you are entitled to cancel the service contract and obtain a refund for the unused portion or compensation for its reduced value. If the failure is not major, you are entitled to have the failure rectified within a reasonable time. If this is not done, you may cancel the contract and obtain a refund for any unused portion.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by law (and except where liability cannot be limited under the Australian Consumer Law), our total liability to you for any loss or damage arising from or in connection with these Terms, the Site, or any Products/Services is limited to the amount you paid us for the relevant Product/Service.

We are not liable for indirect, consequential, special, or punitive losses (including loss of profits, data or business opportunities).

16. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms or misuse of the Products.

17. Privacy and Data

Our store is hosted on Shopify. Your personal information may be transferred to, stored, and processed on servers located outside Australia. We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which forms part of these Terms.

18. Accuracy, Completeness, and Timeliness of Information

We strive for accurate information but are not responsible if content on the Site is inaccurate, incomplete, or outdated. Use information at your own risk.

19. Termination

We may terminate or suspend your access to the Site or Services at any time, without notice, for any reason (including breach of these Terms).

20. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full effect.

21. Entire Agreement

These Terms (together with our Privacy Policy and any order confirmation) constitute the entire agreement between you and us.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
